These Terms of Service (“Terms”) govern your use of the Noah mobile application and any related services (together, the “App”). Noah is operated by Ondřej Popelka, a self-employed sole trader (živnostník) registered in the Czech Republic (“Noah,” “we,” “us,” “our”).

By downloading, accessing, or using Noah, you agree to these Terms. If you do not agree, do not use the App. Our Privacy Policy also applies: https://noahapp.framer.website/privacy-policy

1. Who can use Noah

You must be at least 13 years old to create an account. If you are under the age of majority in your country, you confirm you have a parent or guardian’s permission to use the App.

2. The App

Noah is a Bible memorization and study app. It helps you save verses, practice with short exercises, track streaks and progress, organize categories, and keep private study notes. Noah is not a social network and has no public feed.

Scripture text used in the App comes from translations included in the product, such as the World English Bible (WEB), King James Version (KJV), and Berean Standard Bible (BSB) for English, and Versión Biblia Libre (VBL) for Spanish, subject to each translation’s license or public-domain status. We do not claim ownership of those Bible texts.

We may add, change, or remove features at any time. We do not guarantee the App will always be available, error-free, or uninterrupted.

3. Accounts and sign-in

You can use Noah as a guest without an account. Guest data stays on your device until you clear it or uninstall the App.

Sign-in is optional. In this version of Noah:

  • On iPhone, you may sign in with Sign in with Apple and/or create an account with email and password.

  • Email and password sign-in is also available on Android where offered in the App.

  • Google Sign-In is not available in this version and is not offered as a way to create or restore an account.

If you create or use an account, you are responsible for:

  • Providing accurate information when you register

  • Keeping your login credentials and device access confidential

  • All activity under your account

Tell us immediately at noahmemory.app@gmail.com if you suspect unauthorized use of your account.

You can delete your account in the App under Profile. Deletion removes the account and associated cloud backup. You can also erase data stored on the device.

4. Pricing and virtual items

Noah is currently free to download and use. There is no payment required and no paid subscription or in-app purchase in this version.

Hearts, diamonds, streaks, and similar counters in the App are free in-app progress features. They have no cash value, cannot be redeemed for money, and are not sold in this version.

We may introduce optional paid features (for example a freemium subscription or other in-app purchases) in a future update. If that happens, we will:

  • Clearly disclose what is free and what is paid before any charge

  • Update these Terms with pricing, billing, and cancellation details as needed

  • Process any in-app purchases through the Apple App Store or Google Play, which govern billing, renewal, and refunds for those purchases under their own policies

Continued use of the App after paid features launch does not obligate you to pay. Free features remain available unless you actively choose a paid option.

5. User content

If Noah lets you save personal notes, memorization progress, categories, or other content (“User Content”):

  • You retain ownership of what you create.

  • You grant us a limited license to store, process, and display your User Content back to you as part of operating the App (including optional cloud backup if you sign in).

  • You are responsible for what you submit. Do not upload anything unlawful, infringing, or abusive.

  • We may remove content that violates these Terms.

User Content is private to your use of the App. Noah does not provide a public user-generated feed.

6. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose

  • Reverse-engineer, decompile, or attempt to extract the App’s source code except as allowed by law

  • Interfere with the App’s operation or security

  • Use automated means (bots, scrapers) to access the App without permission

  • Impersonate another person or misrepresent your affiliation with anyone

We may suspend or terminate accounts that violate this section.

7. Intellectual property

The App’s design, code, branding, and original content (including original UI, lesson structure, and original study materials we create) are owned by Ondřej Popelka or used under license. Bible translation text is owned or licensed by its respective rights holders, or is public domain, and is not owned by us solely because it appears in the App.

You may not copy, modify, distribute, sell, or lease any part of the App or its original content without our written permission, except as allowed by applicable law or by a translation’s own license terms.

8. Third-party services

Noah may use third-party services to operate the App, including Apple (App Store and Sign in with Apple), Google Firebase (authentication and cloud backup), and Google Play (Android distribution). Your use of those services may also be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

Google Sign-In is not used for Noah accounts in this version, even though Google Play or Firebase infrastructure may still be involved in distribution or backend services.

9. Termination

You may stop using the App and delete your account at any time using the in-app delete option in Profile.

We may suspend or terminate your access if you violate these Terms, with or without notice, to the extent permitted by law.

10. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement, to the maximum extent permitted by law.

Noah is a study and memorization tool. It is not a substitute for pastoral counsel, professional advice, or any form of therapy or crisis support.

11. Limitation of liability

To the maximum extent permitted by Czech and applicable consumer law, Ondřej Popelka is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of (a) the amount you paid us, if any, in the 12 months before the claim arose, or (b) EUR 50, except where liability cannot be limited by law.

Nothing in these Terms limits rights that cannot be waived under mandatory consumer protection law in your country of residence.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold Ondřej Popelka harmless from claims, damages, or expenses arising from your violation of these Terms or misuse of the App.

13. Governing law and disputes

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles. Subject to mandatory consumer protections that may apply in your country of residence, disputes may be brought in the courts of the Czech Republic.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will update the date at the top of this page and, where appropriate, provide notice in the App or by email. Continued use after changes take effect means you accept the updated Terms, except where mandatory law requires a different process.
